Questions concerning Social Security Disability

Whose responsibility is it to prove you are disabled?

The burden of proof is on the person applying for benefits. SSA will consider all the information in your file but if you have not submitted the evidence that believe supports your claim SSA will not consider it. Just because you tell them about evidence that may exist it is your responsibility to get it for them.

What if I have been found disabled by the VA, Workers comp or Long term disability insurance?

A decision by another agency is going to be based on that agencies rules and regulations. Social Security has it’s own rules and regulations and they are not bound a decision of another agency. I have seen cases were a person is determined 100% disabled by VA but SSA determined that the person was not disabled under their rules.
