What to expect during an SSDI appeal in Illinois

The Social Security Disability Insurance appeal process can seem overwhelming, but understanding what to expect can help you prepare for each stage. 

When the Social Security Administration denies a claim, you have the right to appeal the decision. The Illinois SSDI  appeal process involves several steps, each requiring specific actions within set deadlines.

Reconsideration stage

The first step in the SSDI appeal process is the reconsideration stage. At this stage, a new SSA representative reviews the claim. You can submit additional evidence to strengthen your case. The reviewer will assess both the original and new information before making a decision. In Illinois, this stage typically takes a few months. If the reconsideration decision still results in a denial, you can proceed to the next appeal stage.

Hearing before an administrative law judge

If the reconsideration does not result in an approval, the next step involves requesting a hearing before an administrative law judge. You must submit a request within 60 days of the reconsideration decision. The hearing takes place at a location near the applicant or via video conference. During the hearing, the ALJ reviews the evidence, asks questions and listens to your testimony and any witnesses. The ALJ may also call on medical or vocational experts to provide additional insight. This stage can take over a year, but it often results in a more favorable outcome.

Appeals council review

If the ALJ denies the claim, you can request a review by the Appeals Council. The council may deny the request, issue a decision or send the case back to the ALJ for further review. This stage often takes a year or more, depending on the complexity of the case.

Federal court review

As a final option, you can file a lawsuit in federal district court if the Appeals Council denies the claim. This stage requires a detailed understanding of SSDI law and can take several years to resolve.
