Dementia and No Estate Planning

Dad gets dementia and doesn’t have any estate planning set up. 😨

The kids are concerned. Can they do anything?

If Dad doesn’t have any documents and is too incompetent to create new ones…this is where the court makes its entrance into your family’s personal business.

It is time for a Guardianship

❌ The kids now have to go through a court process not unlike a LIVING PROBATE. 

👎 A JUDGE (who doesn’t know your family) will decide who’s the right person to take care of dad, manage his money and decide where he lives.

👎 The kids will be paying a bunch of LEGAL FEES they didn’t want to pay

👎 They’ll have to give the COURT REPORTS on how things are going with dad

👎 Dad will have his rights taken away and given to someone else.

Avoid this by having a power of attorney and healthcare directive set up RIGHT NOW. Otherwise, this is what our children are facing.
